Castle Rock vs. Gonzales

September 20, 2005

In the recent Castle Rock vs. Gonzales case, the U.S. Supreme court ruled that police cannot be sued over the way they enforce protective orders.

Jessica Gonzales of Colorado claimed the police department of Castle Rock did not do enough to prevent her estranged husband for murdering her three daughters. Gonzales sued the Castle Rock police department after her husband violated the restraining order and took the three girls from her front yard. She felt the Castle Rock police department ignored her pleas to find her husband after he took the girls.

Some say nothing has changed, that police still are responsible to enforce restraining orders, while others argue that this new ruling sends a message that protective orders aren’t worth anything.
